12 yo Debt - Private Investigator


What is the name of your state? NC

I had a car repo'd 12 years ago and it was charged off at least 10 years ago (NC SOL is 5 years).

The debt has been sold many times over the years, but this new one is VERY aggressive. They call and leave a computer message every day. I have never answered the call or called them back. Should I?

I think my daughter might have answered one of these calls though, and verified that they had the right telephone number for me, and verified my address.

Well ...yesterday I had a Private Investigator show up at my house trying to serve some kind of paper and tried to get my daughter to sign for it!

He did ask her if she was 18 and she told him she wasn't, so she didn't sign for it. But he gave his name and number and said I should call him for 'Deposition & Service of Paper'. He told my daughter; "They will not stop, and the next time somebody comes out here, it will be a sheriff"

What should I do???????

I do not know NC laws but one thing I can tell you. Be wary of phony court papers. There are bill collectors who use these tactics to intimidate unsuspecting consumers and try to reaffirm the alleged debt by having you sign a written agreement. By reaffirming alleged debt, you will find yourself without the protection of SOL.

If that person comes again to your home trying to “serve” you. Examine the papers closely if you are not sure then seek attorney’s help. If you have, no money for attorney look for low cost legal clinic or the Legal Aid Society
