2006 Bankruptcy, now repo of vehicle


What is the name of your state (only U.S. law)? New York

I had a Chapter 7 Bankruptcy in 2006 and they were not supposed to include my vehicle in it but they did and it shows as discharged on my credit reports. At the time I tried to get it corrected with the bank and credit reporting agencies to no avail and they basically just stated to continue paying the loan. I couldn't afford to pay the lawyer any more to deal with it. I have now let the car be repoed because I can no longer afford the payments (single Mom, baby on the way in 5 weeks and on Social Security Disability). They are set to auction off the car after July 3rd and I do understand I am responsible for the balance but my question is basically what can they do to me right now that my income is so limited/Social Security? Also, can they override what shows as a discharged Chapter 7 debt with a judgment for the balance?

If you did not sign a reaffirmation with the bank, they will not come after you for any defiency. That amount will be considered discharged by the bankruptcy.

I don't recall signing anything after, I just continued to pay the loan up until I couldn't anymore this year.
