Agreement to pay on judgement Question (help!)


What is the name of your state? CA.

I am helping an unemployed family member with 2 default judgements against him.

One is willing to either arrange payments or let him pay the full judgement amount plus the interest which is in the $8500 range. The OC was Discover & the Judgement was in 2006.

I am posting b/c I would like to have some help on how we should ask the law office/CA to word the letter we'll agree to. (which we plan on doing tomorrow)... we will walk a check in if needed.

From browsing here I believe we should ask that all neg. marks be removed from CR and only a (agreed to) "Judgement Paid" note will be left.... do we also need to have them state that upon the check clearing a (I think this is right) "Clerk's Certificate Of Satisfaction of Judgement" be filed?

Had some input to see if we could "set aside", etc... but seems to be too much work than to just get this off & get my brother a fresh start.

PLEASE any thoughts of feedback would be my helpful.

The best you are going to get is:
A satisfaction of judgment will be filed as required by law.
The credit bureaus will eventually pick that up, but your family member can mail them a copy to speed it up.

So asking that all other notes be taken off is a waste of time? "judgement satisfied" is fine I know his credit is "history"... so that's not the big issue here.

The issue is paying his debts & to make sure no other CA's add to the mix. Thankfully several others want to settle for as much as 40% & 50% off their inflated balances.

Other than requesting this language in the agreement... How else does one insure that upon pay-off recieved, that another CA might come along claim he owes them as well ?

The only other thought was to request that the payment be made thru the court. Possible?

I just want to help him out, as he'd do the same if roles were reversed.

I hate to put it this bluntly, but there is a judgment.

He has no room for negotiation. And playing the stupid "I want to pay it through the court" nonsense is what got him in this situation to begin with. 1. Courts don't do anything for free.2. Who do think will be paying for that service?

Either help him pay is bill or don't. But don't try to play games.

will help him. . I just want to make sure I am paying the right collector once & for all.

thanks. Though paying through the court would @ least give us a legal reciept/record. Why is that stupid?

Contacted a good atty & he will be making a Motion to set aside Default judgement, as he was never served a summons on one & the other did not validate his debts when he set off a Debt Validation letter w/ return reciept.

I now understand why there are lawyers.
