Am I Still Required to Pay?


What is the name of your state? MN

In 1996 I defaulted on a credit card, to the tune of just over $3k. I'd just lost my job, had no money, and pulled a Scarlet O'Hara. As I recall, I did not receive any demands of payment, except immediately after I stopped paying, for quite some time. A year or two ago, I received a letter from an attorney's office to pay the debt, which at that point had climbed to over $10k. I, being the bury my head in the sand type of person, ignored it, as I didn't have that kind of money. The communication stopped until several months ago. I am getting calls at least twice a day, seven days a week, regarding this debt. Thankfully, I have Caller ID, and don't answer. A couple weeks ago, I got a letter from the attorney's office, stating that I can make two payments, both in the amount of just over $1k, half to be paid by the end of this month (October) and the other half to be paid by the end of November. The letter states that this will settle the debt. A week or so ago, a cop showed up at my door with a summons to appear in court October 30.

I've had to borrow the money from my parents to pay this debt. But what has been niggling at my brain for all this time is the statute of limitations. I truly don't think I heard anything about it for more than six years, closer to 10. I never received a letter of judgement, just the constant phone calls and occasional letter.

Should I accept this offer and pay it off in the two installments? Will that end it, or can they still come after me? After this much time, should they even still be pursuing it?

I don't know what to do. I need some help as soon as possible! Thank you so much!

Just because you screwed up with one debt and evaded it for so long, does not mean that that is the debt for which you are being sued.

It sounds like you never received a lot of anything which raise a big red flag to me. If you have to be in court on the 30th, I'd be there.

But without more information, there is no way anyone can help you.

Your best bet is to borrow the money and accept their offer. Be sure to get everything in writing!
