Arrested for bad checks


What is the name of your state? GA

My apologies if this is the wrong forum. I'm not sure if it's more suited for the arrest forums, but here goes. My mom was arrested for writing bad checks last night, and has been charged with 3 misdemeanor counts of Check fraud. I haven't talked to her, but through my brother I have a vague awareness about the situation. The total amount of the checks she's being charged for was under $250, but apparently they've been outstanding for 4-6 months. She put her house (which is also my childhood home and I still have stuff there) up for bond, which was $3700-ish. She was planning on using the home equity she has to repay apparently several thousand dollars more in bad checks she's written, but I'm pretty sure if there's a bond on the house, no bank will touch her. Is this correct? My ultimate question is will any of this affect my financial stability? The only financial ties I have with her would be that I use her on my student loans coz she's (obviously) got horrible credit. I'm 22 years old. I have no plans on speaking with her. Should I be worried about any of her debtors coming after me? Thanks so much in advance.

No, you don't owe her debts. No, she cannot refinance her home.

I think she was going to get a home equity loan, but either way it cannot be done due to the lien on the house from the Bond company. Until she pays the bond, she doesn't own her house. Right?

My apologies. I wasn't aware it was a crime to ask questions and be curious. I believe knowledge is power, and one only learns by asking questions. Sorry I don't have any legal advice. I am also sorry for replying to your message, but as a mother who has a judgment against her and the mother of a 23-year-old I want to thank you. I thank you for making me realize what an absolutely wonderful son I have. A son who would never turn his back on me for my problems, a son who would never think of himself in a time of family crisis, a son who would come to my aide no matter what the circumstance. You know, the way family should be. Thank you, you're something else and I pray for your poor mom.

Yes, she owns the house - her name is on the deed right ? If she has a mortgage, then the bank has a security interest in the house and can take it if that mortgage is not paid. The Bond company also now has a lien on her house - which means she cannot sell the house until that lien is paid in full to the bond company.

Just want to clarify something so the OP is not confused:

The secured party can force the sale of the house and can keep only the amount owed (principal, interest, fees, etc), but cannot keep any monies in excess of that amount.
