Asset Acceptance/MCM/Cavalry/Island National


What is the name of your state? PA

Trying to sort my mothers finances....some credit card debt - 2001 - 2003 - which she used for medical payments (prostate cancer - shot $1200 - when they couldn't get an approval in time for a dr. visit, etc..) we never knew about - and she's 82 and doesn't even remember.

So now they are sending the "getting your tax return?" letters and some great settlement offers - but I have no idea if they are legit......what the debt/who the debt was with.....Best way to go about checking? ThanksWhat is the name of your state?

Several questions.

1. When was the last time Mom made a payment on these debts? The statute of limitation in PA is 6 years for a credit card and 4 years for unsecured non-credit card debt.

2. Is Mom financially able to pay the debts?

3. Have you looked at Mom's credit report to see what is listed?

Answers to questions:


She has not made payments to any of these cards since 2001 - one payment in 2003 for one of the collections.

She has no negative account status on her credit report - For the collection owed - I can't find anything for such accounts on her report.

She is on a fixed pension, has a home equity loan, and would not be able to pay what these collection people say are due. I especially like the ones that offer a reward prize - radio - CD player**************...that's why I am hesitant to pay them.

The ones with last payment in 2001 are out of statute. Just send a letter from mom and say "cease and desist all communication".

The one with last payment in 2003 could be argued either way. I would just hunker down and ignore it. You don't need to answer any of their letters. But, if a court summons arrives, then get back with me and we can talk about how to respond.

Sounds like Mom is basically "judgment proof". That does mean it is OK to ignore a court summons but I think she has nothing that warrants a lot of worry.

asset acceptance is a bottom feeder collection agency that buys debt that is already time barred and then tries to threaten you into paying them. We sued them and WON a settlement from them for FDCPA violations. Do nothing with them if I were you. Send them a letter RRR telling them not to contact you again unless they are suing and leave it alone.
