I received a summons and complaint from a law firm that I was being sued for a 3 year old credit card debt that was written off. I'm being sued in CIVIL court, not small-claims for $3500. I answered the complaint within the time and took it to the court. Now I have received a pre-trial questioner that I need to fill-out and return in 10 days. Anyway...I was looking over the original complaint papers and I noticed the attorney didn't sign the complaint. Is this a legal loophole I can use to motion for a dismissal? Just curious.
Oh, and I read a posting from ladyred that when answering a complaint you shouldn't answer by writing in ink on the complaint nor should you just write a simple answer like, "I dispute the validity of this debt". That's exactly what I wrote on the compalint when I answered it. Was that bad?
