Auto Co-Signer/Owner Rights in TexasWhat is the name of your state Texas? My mom co-signed for me to get a suv because I got pregnant and did not have any credit. At the time, I had a job and could pay the payments. My boyfriend and I separated, my mom told me she wanted me to quit my job and she would support us (my child and I) while I went back to school. I am now reunited with my boyfriend and he is supporting us, but I am not working so we can not afford the payment. I have asked my mom repeatedly to let me either sell the car or trade it for something we can afford. She says my only option is to give her the car so she can sell it and keep the money. I have called the financial institution and I am told something different every time I speak to them. I also tried taking it to CarMax and they will not purchase the car without her consent. I don't want a repo on my credit. I don't think it is right just because my financial situation changed (partialy because of her) that I should lose my vehicle. Is there anything I can do?!!? Anything at all?!! |

| you could refinance the car, so you can get her off the title, and off the bank note, and then turn around to resell it - or keep it by making the payments ... either way, she'd be off the note and title, and you'd be free to do what you like. If you get approved to refinance, and she still refuses to cooperate, (you'll have to ask an attorney but ...) you may have ground to sue her in order to have her removed from the note, contingent upon you being able to refinance without her being a cosigner on it. --Dave.
