Auto Repossession


What is the name of your state? Pennsylvania

In september '06 i was laid off and of course, money is/was tight. I had fallen behind on my car loan by making only partial payments for sept, oct and nov. in december i was contacted by a collection agent hired by my bank and i agreed to make a large down payment immediately and then tap my savings in order to bring my loan current.

I made the second payment on 1/29 which brought my account current (i verified this through my online banking as well as through customer service at the bank) on 1/30 a repo man showed up at my house at 2am and had my car hooked up to his tow truck. i informed him that i had brought my loan current and asked why the car was being repossessed. he stated he didnt know the reason but that i would have to contact my bank and that he was taking the car whether i wanted him to or not.

i live in a rural area with a 3/4 mile stone driveway and therefore have always felt secure in leaving the keys in my car. he had the keys and when i asked if he had any paper work to show who he was or what grounds he was using to take the car he told me he wasnt giving me anything. is this repossession legal?

i called my bank and they stated that although i was current my car was repossessed and they would not discuss the matter further. they gave me an 800 number and a name of the collection agent i needed to speak with. i called and was told this person was not in at the moment and he has yet to call me back. help?

the repossessor should have provided you with a repossession notice when asked. in addition, the repossessor is required to report the repossession to the police as soon as practical. since he didn't give you a copy of the notice, call the police and report the car as stolen. they will either tell you that they have a record of the car being repossessed, or will take a report.
