Bank Garnishment/LiensWhat is the name of your state? I live in Maryland. I have an old debt that's over 10 years old and Wolpoff & Abramson tried to put a lien on my old bank account, which I closed last year, but I still received the court summons that my bank account funds have been garnished. This debt is no longer on my credit report. Since, they wasn't able to get any money from my bank account, do you think they will try and garnish my wages? How can they still try and collect on a old charged off account that's over 10 years? How can I put a stop to this from happening again? Please advise on what I should do. |

| The time to fight this is when you were sued, not years later when it is too late to do anything.

Bank Garnishment/LiensThanks for all your responses. The statue of limitation in Maryland for a credit card account is 3 yrs. Should I answer the summons in June and state that the SOL has expired to have this matter recorded in the court records? Should I contact the law firm or creditior to let them know the SOL has expired? |

| If they're trying to levy your bank accoun they already HAVE a judgment. The SOL is a moot point now. Judgments in MD are good for 12 years and may be renewable. The question then becomes when did they sue you ???

| Possibly, but not all judgments wind up on credit reports.

Bank Garnishment/LiensThe case was filed in Virgina, which is where I use to live. I just recently moved to Maryland and they don't have my new address. The summons I received regarding the lien on my bank account was also in Virginia courts. I know that the case is over 10 years and its been removed from my credit file, because its over 7 yrs. Does the SOL start from the date of the Judgement or from when the account went deliquent? If an account has been charged off, what are they still trying to collect? |

| what are you not understand? if they have a judgement already, then it is too late to argue that the SOL has expired. the SOL is from the date the account went deliquent, but they already took you to court and WON now they have a right to try and collect on their judgement anyway they can. here is a credit message board that might be of more assistance. | In Florida A judgment last for 10 years , with an option to renew for another 10 years. Check the courts web page in your state for Judgment info to see lenght of time they can run. |

| I told you, Judgments in MD are good for TWELVE YEARS and may be renewed. The judgment time period runs from the date it was rendered against you - so you need to know exactly when that was. When the debt went delinquent is irrelevant at this point, the debt has been reduced to judmgment.
