Being Sued for Credit Card Debt


What is the name of your state? Michigan

I have enrolled in a Debt Negotiation Service and I have been sued any way, I received a letter from the court that the credit card company has won the lawsuit. I have a Jeep that is financed and I still owe on it for two more years. My concern is can the credit card company take my car or take any action being as the bank still owns it for two more years??

Debt negotiation only means something if the creditors are willing to accept their offer -- they are under no obligation to do so. Most of those companies scam people who are having enough money problems.

Yes they can sue you. And apparently they did and you either ignored it or lost. Now they will use the power of the court to collect. There are many people on this board that will tell you what they can touch, what they can't touch and so on -- the bottom line is that you need to pick from the following options:
1. Pay them the judgement
2. Ask the court for a payment plan
3. Hire an attorney, then pay them or ask for a payment plan
4. Review the exemptions for your state and answer your question then pick from the remaining options
5. File bankruptcy

Of these the cheapest is option 1 or 2

Check your state website for what is exempt from judgements. Sometimes its wages, a certain percentage of your income, your homestead, certain personal property.

Also verify and get a copy of this judgement if indeed it does exist. Were you served according to your state law ? Check the amount .

Debtcollectors response is partly factual,self serving, and bias. Take it with a grain of salt. Notice that 5 of the 6 matters involve YOU HAVING to PAY back. Soo A-Typical of a debtcollector. They mis-representative ALL the true choices you do have and only favor that which serves their industry.

This "Debt Negotiation Service," is it by chance through US Credit Management? If so, get away from them now!!!

Did you go to court or file and answer when you were served with the original summons? Please say yes! You CAN file an appeal and ask the judge to approve affordable payments.

I was taken to court on two debts. On the first, I was scared into settling by the attorney(collector) with monthly payments that were slightly too high. On the second, I refused to settle, then told the judge what happened with the first, and he was rather sympathetic. I probably depends on the judge, and whether s/he's in a good mood or not.
