bradley rephenWhat is the name of your state? wi After paying a collection debt for a judgment to the offices of Bradley J Rephen, I received a letter from this firm informing me that my debt has been settled in full. I forwarded this letter to my court clerk (along with the appropriate fee) to have the judgment removed. The clerk informed me that the letter was not acceptable--that I would need a Satisfaction of Lien form. I subsequently contacted Rephen informing them of the court clerk's requirement. Since I did not receive the appropriate Satisfaction...form after this contact, I contacted the firm again. I was told that the letter was sufficient. I could not get through to this firm that a letter was not acceptable to the Clerk of Court. How can I get a Satisfaction of Lien from Bradley Rephen?? My repeated requests to this firm have been ignored. I would like to receive the Satisfaction to clear this judgment and improve my credit. Thanks for your response. |

| Check your state statutes and the court clerk may be willing to give you more “information”; they are prohibited from giving you “advice”, so phrase your request appropriately. When a judgment is satisfied and the fact of satisfaction is not filed with the court, you can file a simple motion asking the court to enter an order reflecting the satisfaction on its own. You’ll need to provide adequate evidence and the letter and copies of payment instruments (if you have them) should suffice. In some states, if a judgment creditor has failed to file a Satisfaction within a statutory time after payment and despite notice (put your request to Rephen in a letter sent certified, RRR), the judgment creditor can be held accountable for attorneys’ fees and monetary sanctions for the necessity of making the motion. You’ll have to check to see if your statutes allow for the latter. | Yeah, like “I’d like to motion the Court for an Order to satisfy a judgment lien. Is there a form, and how do I arrange it?” That would fly. “How do I fill this out?” That won’t. |
