CA called work to garnish wages


What is the name of your state? CA

I received a letter from a collection agency about a debt owed to OC (Discover) on 11/17. Received phone calls on 11/18, 11/19, 11/24. My husband called CA on 11/24 to offer a settlement but they refused. I sent DV letter, CMRRR on 11/30 to one of the CA's locations. On 12/1, I sent another DV to CA location on first contact letter and a settlement offer to Discover's HQ in IL, both CMRRR. Then today, received a call at place of employment saying they need info to garnish wages! Luckily the supervisor told them nothing and they hung up.

What should I do now? I've heard that Discover will sue for any amount owed so I'm kinda scared about that. I've received no judgment against me in the mail or anything of the sort.

Yes, Discover will sue but they can NOT garnish wages without first suing you and winning a judgment. Their statements about 'garnish wages' is pure BULL, they can't do it, not without going thru due process of law for a lawsuit

How old is this debt, when did you last pay DISCOVER ??

If you want to stop the calls, you can send them a cease and desist letter telling them that they must contact you in WRITING ONLY, and that your employer does not allow such calls at work. That SHOULD stop the phone calls.

Its not that old. I was in their hardship program and it ended October 03. I sent them DV letter with no telephone contact with me or employer a day before they called my work. I sent Discover a settlement offer on 12/1. Do you think they'll go for it if I offer to pay 50% of my debt?

50% on a debt that's a year gone bad ?? They might.. there's just no way to tell for sure.

I actually offered more than 50%, on a $1900 debt, I offered to pay $1000. I hope they take it.
