Can the bank garnish a 1099 for repayment on a repossed vehicle.


Florida My husband and I are independent contractors, He was just told by a court order through a bank that we had a car loan through that was repoed some years back and when they sold it at auction it sold for $5000 less than what we owed. They talk to us about a paper to sign sometime back and making payments even though my husband crossed out the garnish wage part they told him he needed to sign that without crossing it out and that they would never garnish our wages. Well now they have a paper from the court telling us they are going to do that, because we could not keep up the payments, due to our drop in pay because of the real estate market. I quess my question is can they garnish his 1099?

I assume by "1099," you mean comopensation as an indepoendent contractor in which case, the answer is yes, those monies are subejct to garnishment unless your particular state proscribes that.
