Can a debt be collected through spouse?


What is the name of your state?NJ
I loaned a friend money and he since up and took off. They money was to help fly his kid to his wife in South Carolina. She lives there and they were some what separated while he was here trying to get work (the kid was here since he has full custody) anyway he up and took off he doesnt work but I know where she works and lives. He has no permanent address since they are legally still married in state of SC is this debt also considered her's..I tried calling her to see if she would tell me where he is but she is not responding .. his cell has since been turned off. Thanks

SC is NOT a community property state. You can't do anything to the wife to get at the husband. You cannot harrass her for payment of her husband's debts, she is NOT liable for them.

If you want to make him pay, sue him.

Oh well thanks anyway I was hoping it was possible. This guy can not be located so guess hard leason learned...

Ohh.. I bet he could be located, he'll turn up. Do you have his SSN or any other information about him. What kind of work he does ? If he was going back to his wife in SC, then that would be the place to look. Does he work under the table ?
The kid has to be enrolled in school somewhere. Does he collect unemployment or other public assistance ?

All I'm saying is.. there are ways to find people and he can't 'hide' forever.

He work off the books, his kid is 3 and doesnt go to school last i heard they were living in a motel but since gone. His wife collects assistance not him she has since moved in with her 'boyfriend' she really has nothing to do with the kid other than 2 times a year. I do have the license plate which turns out is not even registered to him but someone else. HOpefully something will come up but wont cross my fingers on this one...I have since found out he stole from his brother and took alot of money from 3 other of our friends. From amounts they were speaking of I am going to consider myself lucky
