Can I sue a collections agency?


What is the name of your state (only U.S. law)? Virginia

I have been getting calls from a certain collections agency for months. They have been calling my cell phone and on average were calling 4-5 times a day. I havent spoken with them , i have just ignored the calls. Well, in the last week they have began calling 16-25 times a day or more and even called me at 9:17pm one night ( isnt it illegal to call after 9pm? ) . Do i have any legal right to take action against them?What is the name of your state (only U.S. law)?

You need to answer the phone...well, perhaps not. I mean, a visit to the courthouse is always fun, huh?

Can you see it now???

OP gets court date as plaintiff against collection agency. Both parties show up.
OP says: "These idiots have been calling me a million times a day".
Judge says: "Well have you answered your phone?
OP says: "Nope"
Judge says: "Case dismissed"

Judge says: "Defendent do you have anything to say?"
Defendent says: "If it pleases the court, can your bailiff please serve the plaintiff for me?"

Bailiff to plaintiff: "You've been served".

**A: search FDCPA and follow the instructions.

You can and should revoke permission to contact you via cell phone. This is if sent a DV mentioning it CMRRR, it will give you addded protection and possible counterclaims. You will not and should not be charged for cell usage after this. Rmember, this board is chock full of Collection agency types who simply want you to pay the bill in full, if you owe it or not,

Sorry, most here simply don't want to defend the poster!

There is nothing in the OPs post to even state he is being called by a collection agency. He doesn't know who is calling him or why. He just assumes it is a CA ... and that it is the same CA.
