Can they levy my account.What is the name of your state? FL Hi, I move to Florida a year ago. When I was living in New York last year, my bank account was Levy for not following an agreement after I lost my job. Now I’m back on my feet with a great job. I call these lawyers to renew my agreement and it was deny, I understand the have no obligation to take payments they want full payment. They try to garnish my check in New York but my company rejected it due to child support obligations. My questions is. What are the chances to levy an account that I just open with my sister for direct deposit purposes only? I know the laws in Florida are different, I'm the only income and head of household. Thanks |

| If you are listed as head of household there is an exemption to prevent garnishment on your wages, but that does NOT stop a bank levy. If your name is on that bank account, and they move the judgment to FL, they CAN get the money in the account.

| Hi Ladynred, Please clarify. A cording to the link suggested website they have to serve me once again in Florida Under the Florida Uniform Enforcement Of Foreign Judgments Act. I’m not sure the tools collector or lawyers use to search bank accounts, but I herd if I have no activity in this new account is going to be hard for collectors to find this new account. Is that truth or not. Thanks |

| That is correct, they must move the judgment to FL in order to enforce it. If they can't find any bank accounts the easy way - with all their tracing programs and methods, then the could serve you with interrogatories or haul you into court for a debtor's exam and you will be forced to give them all your financial information -- and you would have no choice. Failing to answer to go to such an exam can land you in jail for contempt. Never underestimate the tools of a determined judgment creditor - there are ways to find ANYTHING.
