| Car repo'd, being sued 4 yrs. later What is the name of your state? Tennessee
Four years ago my mother's car was repossessed. She had financed it almost a year and a half before the reposession, and was then two months behind on payment after losing her job. She received one or two letters immediately following the repossession stating her final balance and then nothing until two days ago when she was notified by our town's Sherriff's department that she was being sued for the outstanding debt.
The company she financed through was bought out by someone else and that is the company now suing her.
My questions:
When given all the legal papers, she was given something she referred to as an "exempt form" for property seizing, in the event that she loses the case and is not able to dish out the thousands she apparently owes the company. She has to list everything to be exempt BEFORE the hearing. She's told me about this over the phone, I haven't seen the papers. Can they really come in her home and take her things? What about the others who live there? If there are no receipts for purchases, will they be allowed to take things that are in the home that do not belong to her?
I am trying to convince her to get a lawyer but she doesn't feel she can afford one. It seems necessary to me. Any answers at all to my above underlined questions?
