Charge Offs


What is the name of your state? Virgnia

I noticed I have 2 Charge offs on my credit report. I understand that if an account has been charged off and inactive for 7 years it should be taken off your credit report and that third party deb collectors cannot contact you... 1) Is this true? .... 2) If it is on my credit how do i get it off? 3) I would like to settle my debt with the company because it's the right thing to do, so what do i do? 3) The last 3rd part colelction agency was very abusive , what do I do for that?

As far as I can remember these accounts have not been paid in 7 + years....

No it isn't true. You will be contacted about the debt until it is paid or you die.
Debtors always say CAs are abusive and harassing and debtors are full of it.

Most CAs and collectors are honest hard-working people that act ethically and responsibly. I really don't understand the attacks on collectors when the debtors are the ones stealing goods and services and not paying for them.

Do some research and come back better questions. You will get better answers. Try reading Seniorjudges standard answer.

Thanks...

However this collector was actually abusive, calling me several different racial names. The call was recorded because I called from work. Unlike most people, I have no problem paying the debt. I attempted to work it out with them, but they wouldnt accept $100.00 a month payments. Thats when the name calling started.

And by the way, I am not blaming anyone for that misundeurstanding, If i would have known about this earlier it would have been delt with. Apparently it occured when I was serving in the military in Iraq. There is no attempt to steal goods and services and not paying for them.

More information is always a plus.
1. If the collector called you racial names, that most definitely fits the legal definition of harassment and abuse under the FDCPA. If that collector worked for me, I'd have fired him on the spot. There is no excuse for that type of behavior.
2. Did you give your creditors notice under the service members relief act?
3. The bottom line here is that if the debt is more than seven years past charge-off there isn't much the CA can do. If you are sure it is that old and you haven't made any payments on it, send them a cease and desist letter. That is just a simple letter that says never contact me again. Include all the info they need to id your account and send it Certified mail with return receipt.

It's like this at this point. The CA will accept settlement offers. They can't do much to force you pay. It's like saying pay or I'll call you again. Don't send them any money without a settlement offer in writing. The minute you pay a dime on the account you revive the statute of limitations.

Your chain of command screwed you when you deployed. They should have made sure all the troops knew about the Service members relief act and contacted their creditors.

after 7 years it has to come off your report. you will always get calls about it, but as long as the SOL is up collection agencies won't be able to do anything.
