checking account garnish


What is the name of your state (only U.S. law)? Virginia
I share a joint checking account with my wife and I found out today it is in negative of $2,386 something about a hold til 2009. What happen a debt my wife owed back in 2005 was defaulted on the problem is we both are on Social Security and our checks are directly deposited on the 3rd of the month(mine) and hers the 3rd wed. of the month.I will have checks returned unpaid and why is my check being effected it was her debt.She was never notified of this going to happen.What can I do I'm pennyless now.

Is the only money going into this checking account social security?

Your Social Security benefits are protected. Take a look at this document I've provided a link for. The information in the document should help you with your request for garnishment exemption.

yes social secuirty is the only money

This is why I always tell people, if you're facing a lawsuit, stop using a checking account/savings account. They are not safe places to put your money. Social Security offers a debit card which is safe from creditors where they will direct deposit the money every month. It is an alternative for people who don't have checking accounts, or can't use them. You can then withdraw the cash from the card to pay various expenses by money orders or you can use the debit card for shopping at any store that accepts debit cards.
