Question

Cleaning up my credit... need advice!!!


What is the name of your state? NJ

I am in the process of cleaning up my credit report. I had a judgement which was paid and set the credit bureas a copy of the paid in full letter and a letter (return receipt requested Thanks to this website) requesting they update my file accordingly. My questions is: if a credit card company reported an account which they charged off and then there is an account for the same item but under the collection agency is that normal and is there anything I can do? Also if a credit card is on our report and it remains on there for 7 years is that 7 years from the date they charged it off?

Also I have a CA on the report for a cell phone. The cell phone company charged off the account in 10/99 and I know come Oct. it will be over the SOL. But the CA keeps updating the report to show the account was opened in July '04 and stating I am past due since Aug 05. I have a copy of a credit report from last year showing the same account opened 10/99. What should I do for this account?

Since SOL is a state by state thing you'll have to research your state laws to be certain...but...as far as your CR is concerned the reporting period, and the SOL in most states is measured from the "date of last activity" or DOLA. That's the date on which the account first went delinquent and was not brought current...usually that's due date for the first payment you missed.

By law, any CA trying to collect on an old debt is bound by the same DOLA...
