Collect against a debtors bk claims?


What is the name of your state (only U.S. law)? AZ or WA?

I received a judgment against a husband and wife (WA State residents) for $20k in August, 2008. The judgment is recorded in King County Superior Court (Washington State.) I am now working on collection. The couple has claims filed with the US Bankruptcy Court, District of Arizona, related to their former employer/franchisor, who filed a voluntary bankruptcy petition under chapter 11 in August, 2007. Their claims are for wages ($46k), business agreement payments ($295k) to the husband personally and ($27k) to the Wa State LLC they own solely and set up to receive payments from the employer/franchisor. The bk Trustee representing their former employer is set to payout claim funds mid-February, 2009.

Can a garnishment or levy be filed with the bk Trustee, against the husband and wife’s claims, in order to obtain payment on my judgment?

Does the filing Attorney need to be licensed in AZ or WA State?

What is the name of your state (only U.S. law)? WA or AZ?

Bankruptcy court is federal. Get a lawyer. I believe what you need is an assignment order. Don't forget you might be able add the attorney's cost to the judgment.

Would I need an Attorney licensed in WA or AZ State?
