Collection Agency has the wrong person


What is the name of your state? Oklahoma

My husband has been confused with our son in collection proceedings. We have been contacted many times by several different collection agencies (they keep assigning the debt) and each time we have to go through many phone calls, sending certified letters, demanding DV, etc. Even though they have completely different ss numbers, birth dates, places of birth, etc. they do have the same exact name with no jr. or sr. attached. We have even had to respond to the Nat'l Arbitration Forum which then issued a stay to that agency.

We have excellent credit, 800 plus on each of us, and this is getting old. No sooner do I get rid of one, then they assign or sell the account to another agency and it starts all over. I even called the OC to demand a copy of the original credit card application(which none of the agencies has ever provided) which would clearly show the ss#, birthdate, employer, etc on it are totally different and prove they are harassing the wrong person.They won't provide it since none of the identiy information matches. We are considered third parties.

We have followed all the procedures I could find on line. I can't tell you how many reg. letters I have sent disputing the debt and asking for proof of validation which I have never gotten. I have a file 12 inches thick with documents sent to these people and everytime one decides that they DO have the wrong person, no records are corrected, they just sell the debt to another agency and it starts all over.
The only up side is they do not have his complete ss# so I guess they can do any reporting on his credit profile. Right?
Any suggestions?

Explain it once, the first time they call. Tell them that this is no longer an appropriate contact# for the debtor they are trying to reach. Threaten to contact the attorney general's office if they continue to harrass you.

If they don't have you husband's SS#, are you sure they are actually confusing him with your son? They may just have a record from the last time your son lived with you or gave your # as a way to contact him.

Even if it was your debt, if you send them notice in writing that you don't intend to pay them they are forbiden by law to contact you again ecxept to notify you of specific actions they intend to take that are specified in the Fair Debt Collection Practices Act.
