Collection from another state, Massachusetts


What is the name of your state? Texas
I have a five year old credit card debt for $1200.00, They called a couple of times saying I was being sued, but they would not give me any info and likewise, I told them nothing making the guy really mad and hanging up on me. Is it likly they would spend the money coming to Texas to file suit against me. The place thats calling is an attorney/collection office. Thanks.

They don't have to come to TX to sue you. They'll hire a TX lawyer in your area to do it for them ! They could also, legally, sue you in MA if that is where you entered into the agreement.

However, if they sue you in TX, you could apply the TX statute of limitations - which is FOUR years. That means you might have a chance to have the case thrown out completely based on the expired SOL. While they COULD argue the MA SOL, it's not all that likely.. they'll sue using TX courts, and you can certainly try to assert TX laws in your favor. If you don't at least try it, then you LOSE that defense. Better to try it and see what happens.
