Collection letter from Asset Acceptance LLC


What is the name of your state? Tennessee

I received two letters today from the above, they were addressed to me and my x-wife and concerned two debts to department stores. These debts are at LEAST 20 years old and possibly older. These debts were incurred in the state of Florida and I have lived in Tennessee for 13 years. What should my next step be, should I dispute the validity of the debt? contact a lawyer? or ignore the letters. Through a Google search it seems this company does sue a lot of people. If they call should I say I don't know have any knowledge of the debt? Thanks in advance for any advice.

The SOL was 'frozen' when you left Florida. However, since the FL SOL is 4 years on an open contract (credit card) and 5 years on a written contract, it would have expired BEFORE you left the state. That is good.

Do NOT ignore their letter.
Send them a cease and desist letter (certified RRR), including a statement of the SOL expiration.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Now I'm really confused...


Chien's answer to my posting on 5/12/06 seems to be contradictory to your very first statement the SOL was "frozen" when this poster left the state. The debt collector had this poster's address and used it to send a collection notice.

So, whenever someone leaves a state, the SOL freezes???

What about a military guy? I was not too savvy with my credit when I was a private, and I am quite sure there are still unpaid debts out there that I do not remember. Does this mean that I could still be sued for them when I am retired (in 2014)? I wonder how much interest would have accrued in 15-20 years?

In most states, that is true.

Then I suggest you make sure you pay your bills.

ASSet sues people on dinosaur debts but if you fight them, they will tuck tail and slink away. They have ZERO proof of anything and they bank on people being so afraid that they'll either pay up or not show up in court, giving them a default judgment.

Tell them to get lost with the Cease and Desist letter.

I sent out the cease and desist letters this morning. I do have one more question if anyone knows. As stated in my first post these debts were incurred in the state of Florida and I now live in Tennessee, if they were to sue would I be forced to travel to Florida to defend myself or would they have to sue me in my current state of residence?

They can sue you where you entered into the agreement or where you live now per the FDCPA. Usually they will sue you where they can find you now, although ASSet has been known to sue in old locations just so they can get the automatic judgment win when people don't get served at a 10 year old address. Watch them.

If were to sue in TN, I'd use the TN SOL it's long past too.
