Collection or not in collectionWhat is the name of your state? Wisconsin What do you do if you have a collection agency trying to collection on a debt for a credit card and the credit card issuer swears up and down the account is NOT IN COLLECTION? I am still honoring my payment plan with the card company. My payment plan is keeping my account in good standing and current. I have a collection agency who says the account is in collection. I need to make payments with them or face legal action. For security reasons the credit card company will not speak with the agency claiming this debt because they are not listed in a database of companies who represent them. I checked with BBB records the collection agency appears to be legit. My question is I would like to know who I pay. I would think if I have a valid repayment plan with the credit card company, my payments should still go to the credit card company. I sent this collection agency copies of everything that I have. My repayment agreement with the card company, statements, payment history. The agency will not budge. I remind you, I am not running from this debt. I am making serious attempts to pay it off. thanksThanks.. Judging how organized these people are. They couldn't sue a paper bag. I think I should have this debt paid in full before papers will ever be served. I hope I won't need to end up paying this debt twice to get it off the books and my credit report. That's the only concern I have. |

| Does the collection agency have the actual account number and other identifying information? Keep accurate records of your payments. Get verification that the checks (if you use checks) were actually cashed. Be sure this is not a second account with the same CC company. If you can, have the CC company write a statement that this account (with actual identifiable account numbers) is on fact not in collections. If you feel the need to continue contact with the collect agency AND they already have the info on that statement, send them a certified letter CRRR and inform them that the account is not in collections per the actual creditor and any further contact will be considered harrassment and threatening actions they not only will not undertake, but do not actually have legal standing to do so and in violation of the FDCPA and if you feel the need to pursue an action, sue them. |
