collections question


What is the name of your state? OH
Hi,
I am curious about this..I got a call from a member of our mortgage
group..I am a little behind and I just sent the payment, including
late fee, for last month...he calls and leaves a message on our
machine that he 'just received check number 1234 for $375..the
December payment is due...this account is not even a year old and is
already 30 days past due..I need you to call me' and so on with the
blah de blah. It would seem that the account is now only TWO days
past due since this happend only two days after the December payment
was due, right? And can he leave info like that on my machine?
Most collectors only state their number and sometimes company name
or case number, never detailed info like that. What do you think?

Okay, I'm not quite sure what you mean by "mortgage group"...but...if these are the people that hold the mortgage on your property...and this guy works for them...then they are the Orginal Creditor (OC). OCs are not bound by the FDCPA or any other legal guidelines that prevent them from leaving messages on your machine. OCs can play a lot dirtier than a collection agency.

Is there anything they can actually DO if the account is 30 days past due, other than bother me with phone calls and late fees? Don't you have to be 3 months past due for forclosure?

If the mortgage company that holds your loan. By Law they can forclose at anything after default of your agreement. I call tell you that most will not.
First off the Mortgage company would lose money, if they did that.
Yes they can leave messages like that.
If you let your mortgage go for 3 months. they could state forclosure on the house, but from the time they start till the time you are told to leave could be depending on state. 4-12 months. I don't remember Ohio's forclosure, timeline.
If you are behind the best bet is to call them and try to work out an arrangement to get yourself caught up.
Like making a Payment and half or a payment and one third. Some will even to a payment and one fourth.
When i worked for the Mortgage companies all of them would be willing to do that, to get you caught up and back on track.
