Question

College loans and Child Support Arrears


Texas

For years my ex did not pay child support. I would file periodically on him and get a few hundred dollars. Then the Attorney General took over the Child Support services and they started garnishing his wages. He moved out of the state and the payments stopped. My children grew up and just before the youngest turned 18 my ex surfaced again and the IRS took his income tax return. Now having an address for him in Florida, the AG's office went after his employer and started garnishing his wages. This went well for the next few years. Now it is all but 2200. paid and the payments have stopped. A call to the AG's office revealed that the arrears had been paid in full by an intercept of his income tax check in May. However it would be held for 120 days. (first week in October)

My question is, because I still owe for my college loans and they have gone into default, will this 2200. child support arrears payment be seized? My personal income tax is taken each year however up to this point, the child support payments have never been taken. But this is the first income tax intercept that has come in since my loans went into default.

Texas is the state handling the case.

A: How will this be paid to you? (Yes, it is possible that the taxpayers may glom onto that money.)

I don't know if the IRS finds out WHO the money is owed to... but you should call the IRS and find out definitively.

Yes, and you don't have to give your name or other identifying info.

(CC: The IRS knows everything...almost as much as Google! )

I think the IRS IS google...

I don't see why the OP wouldn't want to use that money to pay off the student loans in default anyway.

Hey SJ, did you catch that the OP is in Texas, The Netherlands???? Since when did Texas move over there? (look at her location, then look at what is the name of your state)

I think SHE is in Holland but the dirty deed was in Texas.

I thought this was a place to ask legal questions and get some answers.

Since I am asking about an legal issue in Texas, I assumed that is what I should list, however, I live in the Netherlands so I put that in my profile. I was not aware that would cause such a reaction.

Obviously this is not the place to get answers.
