Colorado SoL


What is the name of your state (only U.S. law)? Colorado

Well, I hope you can help me figure out the CORRECT site to find research the Colorado SoL Laws. I am trying to clear up my credit after a divorce (aren't we all?) and I have paid and disputed and argued with bill collectors and thankfully had some things removed.

I am stuck on a few debts though, I am trying to figure the real SoL's for Colorado, I have seen many sites stating different time frames. I am also unsure of what exactly falls under what as far as written contracts, verbal contracts (I have none of those anyways) credit cards etc.

I also would like to find a site that will explain to me, example: 'total loss' on a car claimed by insurance company with a lump payment made to original creditor. Reasonable amount to be covered by GAP insurance, which failed to pay until 5 YEARS later!!! Original creditor filed as charge off, then 180 days late, then resubmitted as charge off AND sold it to a credit collection agency. Credit agency beginning balance showing way different than that of the original debt, and their dates are also different for the debts beginning time frame.

Do I go off the original that is claiming charged off with 180 days followed by another charge off status or do I go off the date it was sold to the credit collections company? Or would it have actually been 180 days from the last payment received? (Do I then have to take into consideration the GAP insurance payment made 5 years later, just last month (June 2008?).

I offered to pay the original creditor last month the remaining balance and they said they did not want my money , I had to send it to the collections company, yet the applied the check sent by the GAP insurance to the charged off, 180, charge off debt. Can I just send them a payment for the balance and was the collections agency away?

Can I just send them a payment for the balance and was the collections agency away?

Sorry - "Wash them away".

If the original creditor applied the payment to the loan, which reflected in the credit collection company. Can I just pay off the original creditor (credit union) and make the original debt vanish, then the collection agency has nothing to try and collect on, right?

You must deal with the owner of the debt which is the collections agency.
