conflict over furniture payment


What is the name of your state? Louisiana

In January 2004 I purchaces 2 pieces of furniture from a local furniture store. Both items were special orders. From prior experience, I know I've been required to leave a deposit in order for the furniture company to order the items. About March 2004 the furniture was delivered to me COD.

In August 2005 we were living in a different state from the one in which we lived when the furniture was delivered. We received a bill from the furniture company for the above mentioned items. We assummed the bill was in error and just ignored the bill. We have continued to be billed for the items.

We talked to the store owner yesterdy and and in his arrogance, he just said prove you've paid it.

The checking account we were using at the time has been closed for nearly two years. I don't have cancelled checks because this purchase didn't relate to taxes. I will be assessed charges to request history from the bank.

I think this was paid; what kind of company would not have required payment on a COD delivery at the time the furniture was delivered? What legal recourse do I have if I can't produce the check?

Not much. Without proof you paid it, you're pretty stuck. Banks keep records for 7 years. Sounds like you're going to have to suck up some charges to get copies of the checks. If you can narrow down the timeframe at least you won't be stuck for too much in charges.

Did you get any kind of receipt from the people who delivered the furniture COD ???
