Additionally because we will most likely end up having to pay them back some if not all they claim we owe and at this time are barely making ends meet as it is we are discussing filing for bankruptcy. Can I go to the hearing and ask for a continuance then start the bankruptcy or would i be better off starting the bankruptcy before the court date if it ends up that bankruptcy is our only recourse?

A: It certainly wouldn't hurt, but that may be the only continuance you get.

Is there a standard time frame for continuances? ie. how much time would i have if a continuance is granted before the next court date?
