Credit Card Summons


What is the name of your state? Oregon
I was just served with a summons to appear to defend the complint filed against me by Capitol One.

They are asking for :
1. $1626.32 I charged on the card
2. Intrest for the 1626.32 at a rate of 25.9%
3. Plaintiffs collection costs at a rate of 25.9%
4. Award for reasonable attorney fee

It's says Plantiff's complaint is (Breach of Contract)

I do not know what to do at this point to minimise the damage and settelment with this attorney/collection company.

Any advise?

I thought I would offer the 1K or tell them I will use the 1K to pay an attorney to file Bankrupt for me. But I do not want to file BK as this is the only bad debt I have. I just can not afford to pay them for this if I can find a way around it.

Also what is worst case if I just keep putting them off and not responding to any of this? It say's on the summons they win if I do not reply in 30 days. What does that me for them collecting from me? Can they garnish from me? I am self employeed and it would be difficult for them to track my income.

If you don't show up they can win judgment and for 10 (20) years will be able to garnish wages or assets. It may be past the time they are willing to deal but you can always try. I would question the dates and verification when I showed up in court.
