credit and depositions


What is the name of your state?What is the name of your state?My name is Diane and I live in the state of Pennsylvania. Right before my 4 yr limit was about to be over I was served with papers to sue me for a loan I had co signed for. Now I am a Financial Manager for 20 yrs in the auto industry. There has got to be some kind of an irony in that. I do understand credit, most credit laws and most importantly I always pay my debts.
I also understand that this makes me responsible for a loan EVEN THOUGH we had a legal post nup agreement. However ....can you imagine my shock when I never got any calls from this Bank that this loan had gone this far? No calls, no letters ...Nothing!!! Now they want a difference of what they say the car was sold for ....some 17,000.00!!!! NO WAY!!!

I can't afford it and I am remarried with new debts and a new baby.

So now they send me some files ...showing 1 letter sent to me in Oklahoma...a state that I never lived. Let me explain that this loan was started here with my ex in Pa. He took off to Oklahoma with a girlfriend. I posted on my credit bureau that I resided in Pa. I also checked the account and knew he had a few slow pays but thought he must of made good for those.

Now my attorney tells me they want to do a deposition for discovery. I will go ...I have nothing to hide ....but dont they need some kind of records? I mean after all I am in the car biz for crying out loud! If this vehicle went for repo I could of got it back and put it on my lot for resale. This is so ridiculous. All they had to do was pull a credit report to see that we lived at two different residences and our last known residence was the home I soley own and still reside in for the past 13 yrs. Help? How can they keep dragging this thing out? Do they have a legal leg to stand on???
