Creditor Harrassing My Child & Can They Take My House


What is the name of your state? California.

I'm in the process of settling $100,000 of credit card debt. I have settled and paid off all but $25,000. Here are my questions:

1. One really nasty creditor has harrassed my minor child. He answered the phone when I was gone, told the guy I wasn't home and asked for his phone number. The guy told my son he thought he was lying, told him he was costing his parents thousands of dollars, told him it would be his fault, and hung up on him. Can I file a complaint against this jerk?

2. If any of the credit card companies files a lawsuit and receives a judgment against me before my loan funds (hopefully funds), can they force sieze my house or my bank accounts?

3. Am thinking of hiring U.S. Financial Management of San Diego to help me. They say they can negotiate the settlement of the 3 credit cards lower than what I've been able to achieve, and save me an additional $5,000. However, the monthly payments will be very steep, and if I am refused on the house loan, I might not be able to sustain them over the 3 years.

Any advice on any of my questions will be really appreciated. Thanks!
