Question

creditor phone harassment


What is the name of your state? WA

Hi Frank here hopping in the forum for an answer. Can a collector call you more then once a week even if they don't leave a message? I have voice mail and they calling me 7-10 times a day. Can I stop them from doing this.

I'm not sure on the rules for consumer debt, but on commercial collectors can call three times /day.

Is it the original creditor calling or an actual collection agcy. that the orig. creditor turned the debt over to? If it's a coll. agcy., you can send them a cease & desist letter saying you don't want to be contacted anymore except to be informed of any additional steps they intend to take to collect from you. They must honor your request. This is per the fed. Fair Debt. Coll. Practices Act. ***See next post by me.

Assuming it's consumer debt and not commercial debt, the C&D letter will get them to stop calling.

A CD can also get you sued.

To answer the OP's question:
No there is no limit on the number times someone can attempt to call. If you are trying to contact someone and they weren't home, wouldn't you call back later?

If you want it to stop, try answering the phone and making arrangements to pay your debt.

OP, it is possible that if you send a cease & desist letter, the coll. agency's next step may be to sue you in court to get a judgment against you for the money owed. However, sending the cease & desist letter should get them to stop calling you. That is the purpose of the letter.

Unless you filed bankruptcy, there is no "sure fire" escape.

Read Washington State Lew


I found the law for collections and it's 3 times a week not before 8am and not after 9pm. It's a collection place asking for a sprint bill right now SMART BUT. I'm working on paying off my SLwhen I get that out of default then Sprint is next. And they are calling when I'm at work I have voice mail they can leave a message. If you wanted to collect the money relly bad WOULDN'T YOU LEAVE A MESSAGE?

Since NCO was sued for leaving messages, the legality of messages is up in the air. Some companies are leaving messages with the mini-miranda, which opens the door for third party disclosure; some just opt to not leave messages at all.
