Are damages due from tenant dischargeable by chapter 7 Bankruptcy? What is the name of your state (only U.S. law)? Indiana (Southern district)
I had a tenant skip out, no forwarding address. He deliberately trashed residence and property, as well as violating local ordinances and laws. Small claims court awarded damages for past due rent, late charges, material and labor costs for repairs and legal expenses. I received notice that he is filing Chapter 7 bankruptcy; form letter stated that if I think his debt to me is not dischargeable, I must start a lawsuit by filing a complaint in the bankruptcy clerk's office. Since his debt is due to deliberate misbehavior on his part, is it dischargeable? If it is not, do I need an attorney?What is the name of your state (only U.S. law)? Indiana
