Date of Last Activity

What is the name of your state (only U.S. law)? Alabama

Collection agency purchased an account. The ORIGINAL debt is no longer valid to be reported, due to it's advanced age. However, the collection company is reporting the date of last activity as of the date they PURCHASED the acct. As I understand, the date to look at for determining the 7 year restriction on reporting is the date of 1st delinquency, or date of last payment. Which pre-dates the purchase by the collection agency by far.

Is this correct, or can they continue to report this account, just selling it over and over to other agencies, till I am old and grey? I disputed the amount with the original creditor, btw, and they chose not to pursue it in court. They just sold the acct to a collector, lol.

Thanks in advance!

Thats called re-aging and is very illegal. Call them on it with a CMRRR to the credit bureaus disputing it, get them on paper confirming it, then file your lawsuit. You win $1000 x3. Provide your docs in discovery.

And that is correct.

Dole, you are the MAN (woman?)!!! Anyway, I appreciate the reply. Honestly, I'd be satisfied if they would just remove the re-aged account. I am looking into your advice though. (The *limited* research I've done into re-aging, btw, indicates a fine of $2500 per occurrance... Not sure if that's correct, as I have only hit 1-2 websites.)

I have a not-quite-close friend at my church who is a well respected attorney here in town, and I think I'll mention this to him next time I run into him somewhere... Not in church, lol.

Thank you again, for directing my research!
