My question to you is , My exhusband reopened our Sear account that I had closed before the divorce, in 2002. He has not paid this account since September 2004 and now Sears has turned the debt over to a third party collection agency who call 6-7 time a day.
Before Sears turned this over to the third party collection agency they had agreed to send me a copy of all the transactions that was on the account they failed to do this and now if I try to contact them they pass me off to this third party collection agency.
What is my recourse in all of this?

Stay off of the phone. Send your requests certified mail, return receipt. Also send a letter to the collection agency disputing this alleged debt. Tell them to only contact you by mail, as it is inconvenient to receive phone calls.
