debt collection


What is the name of your state? ALABAMA..I have a collection attorney named Gerald E Moore calling me about a old MBNA account i had that they have now. T hey sent me a certified letter from some kind mediator forum that said that if i didn't respond in 30 days there would be a judgement i would have to pay.They call all the time and have said that if i don't pay they way they want and that is $2000 by monday they are going on with the judgement.I don't want my pay check garnished.I'm willing to pay monthly until the debt is taken care of.I just don't have the lum sum they want all at one time. Can send them what i can afford every month as long as i sent something.If i don't come up with the money by monday they said the settlement they are offering will be taken away and i will have to pay the whole judgement.

go to budhibbs.com and you will see all the info on this piece of garbage moore. he was bothering me too..until i sent him a copy of budd hibbs website info on him...hope this helps

Bud Hibbs is an idiot and I doubt anyone sending a website to the CA would mean anything.

Moore is scum. But, so what? It is not illegal to be scum and I highly doubt they give two cents what you think about them.

The first thing you need to do is determine if the debt is out of statute. The statute of limitations begins to run from the date of first default. DOFD is almost always 30 days after the last payment you made (after which the account was never current).

AL SOL for written agreements is 6 years and for open accounts is 3 years. Strictly speaking, per federal TIL, a credit card is an open account. However, judges in some states are saying that credit cards are written agreements. I have no idea what AL judges are doing.

Being past SOL does not mean you cannot be sued. It only means you have an affirmative defense to the lawsuit and can easily have it dismissed if the debt is time barred.

That is step one.

Sounds like Moore is pursuing arbitration -- probably through NAF (which are the scum that forms on top of plain ole regular scum).

why would you send them anything there is nothing they can do...idle threats thats all.....call them like i did and tell them they are scumbags and they will leave you alone....or pay them for the rest of your life**************.

Oh the horror of watching the uninformed try to lead the blind....

You got that backwards sparky. Pay them and they will go away. Play games with them and they will be your 8am wake up call for the rest of your life or until you seek good advice from someone qualified to give it.

Debt guy gave you good advice -- search the forums there are hundreds of threads that will advise you how to handle your issue.

A. You send them what you agreed to send. You cannot force a creditor to take that you want to pay.

Ignore rpivending unless you think you will enjoy a judgment.
