| Just on what you've posted, the answer is (a qualified) yes. This is apparently an original creditor (not subject the the FDCPA) and you don't explain the reason for the call or what was said so, based on the post, yes. |

| this account ha been turned over to a collection agency. they demanded that i pay a sertian amount even tho i told them that amount of money would not be aviable that day offerer asmaller amount she would not except , then said that each month a debit of of bank account would be automatic. I am not able to work because of a back problwm would like to pay this but it will put a real hardship on me to do it the way they want me to.Can they force me to pay more than i can afford each month |

| Now it's not clear for what purpose the CA contacted your family member (because now we are back to the FDCPA and there are restictions), and I'm unclear whether your concern is really about the call or the payment demand. For the moment, let's just say that there are restrictions on the reason(s) for speaking to a family member and on what is said. No, they can't force you to pay more than you can afford, but they can choose to sue you if a mutually-agreeable payment arrangement is not established. And I would strongly advise against giving banking information and the right to make automatic withdrawals as a means of payment. |
