Debt collection on $5600 loan from an EX


What is the name of your state (only U.S. law)? CA

Nearly 3 years ago I separated with my then girlfriend. I had over the course of our relationship loaned her a large amount of money of which she always agreed she'd pay back. Since our separation, I've asked her to pay the sum back and she keeps telling me she doesn't have any money and has been sick and although employed as a nurse manager, she is supporting her now-husband through his schooling and had bought a dog and has no extra money to pay me back.

Each time I asked and this was her response I said, OK, I don't need the money so I'll be lenient and ask you later. Finally, I'm in the position of needing the money and have asked her several times in email for the money suggesting a payment plan on $50/month or similar. Each time she says she doesn't have any extra money and can't pay me back.

I've gotten to the end of my rope and would like to know what my legal or other recourse is in this situation. Oh, since we separated, she moved to Wisconsin and got married this past Summer. We left our relationship on amicable terms as a mutual separation and she left to be with her grandfather during his last year of his life should that make any difference.What is the name of your state (only U.S. law)?

documentation


I can't find the documentation where I added up all the $ she owed me. The only thing I still have is a payment schedule and note that we both signed about me lending her money to buy a car. Since we separated, I was asked to sell the car and she paid me back a portion of the amount she owed me for the car. However, she never tore up the said document.

The other documentation is a number of emails recently back and forth where I've asked her for the money and she continuously doesn't deny owing that money but rather replies that she doesn't have any money to pay me back at this time.
