Debt Collection SOL What is the name of your state? Rhode Island
Hi,
6 years ago I defaulted on my cc payments. It charged off in April 2000. I lived in California that whole time, and I have just discovered that the statute of limitations expired 2 years ago (in CA). But about 7 months ago I moved to Rhode Island. The statute of limitations in RI is 10 years. As of about 6 weeks ago, I have been called daily by NES (Nat'l Enterprise Systems, I think they're owned by LVNV Funding). They are threatening a lawsuit. The original amount of debt was about $1000 (6 years ago). Now they're demanding $2963. Am I stuck with the RI SOL, or does it count that I lived in CA for 2 whole years after the expiration of the SOL there? I am so new in this state, I don't even have legal residency yet. Didn't file taxes here, am an out-of-state student. I want these people off my back. I made a mistake a long time ago, got myself together. Now they want to get a judgement against me, which (in RI) will last for 20 years, I think. Are they full of it? Am I safe? What is I acknowledged the debt as mine, over the phone? Does that restart the clock?
Help. I'm wigging out.
Oh- I have one more question: I looked at my credit report today. It has this debt on it, but it also says "Date updated: 04/2006." Does this mean they've restarted the clock on my debt, like it's brand new?!
