Debt collections after death


What is the name of your state? Indiana

My sister-in-law recently passed away. She was divorced with one son, age 22. Her son lives on his own, attends college and is self supporting. I know my SIL left some debts, including medical. She did have life insurance, although we're not sure how much, yet.

Should we ignore any bills, send a copy of the death certificate to each business or simply pay the bills? Is her son, or anyone in the family legally obligated to settle these debts?

Any insurance monies left after burial expenses we want used to continue her son's education.

I appreciate any advice.

The debts of the deceased should be paid from the estate of the deceased.

Her son or other relatives are not personally responsible for the debt.

Insurance proceeds belong to the beneficiary and are not part of the estate.

Normally, the order of priority of payment of assets from the estate are (1) burial expenses (2) secured creditors (3) unsecured creditors.

If the estate does not require probate, simply send a letter and a copy of the death certificate to each creditor.
