Debt in France collecting in USA


What is the name of your state (only U.S. law)? NJ

Good Morning,

I have a few questions regarding a debt I owe in France. A debt collecting company has send me letter to have me pay for the total amount we owe. We cannot afford doing this. They haven't accept the planning we propose. We cannot have a loan because we don't have any credit history and we cannot have an house equity loan. We just bougth the house in May. My questions:

1/ Could the creditor sue me here as it is a debt in France and the contract has been sign there?
2/ If yes, we bought a house in nj, with both my husband and me siging for the mortgage. If they sue me , I know they will have a judgment against me because the debt is valid. How dooes it work? Will I have to reimburse the total amount in one time even if I don't have savings? Could they take money from my husband salary? Could we loose the house, have to sell it to reimburse everything?
3/ If I have a judgment against me, will I be able to apply for the green card, we have a visa right now?

You are asking several questions including ones that involve right to work issues that I cannot answer. As to the creditor situation, the creditor in France can indeed pursue you in the US. The procedure is simple. They sue you here, obtain a judgment and invoke their post judgment remedies which can include: garnishment of wages, attachment of bank acoounts and liens on property. My advice, therefore, is not to try to hide, but instead attempt to work out a setlement with your creditor.
