Question

Debt & Leins


What is the name of your state? New York

My wife is being Sued for an outstanding Debt on a Credit Card. She has been served by the Bank on the Credit Card. We have been paying what we can on the card but the bank wants more money than we can afford. My wife is a housewife & cannot work. Since my wife called the Lawyers & was told she cannot talk to them by a clerk. The clerk did suggest we either A) Pay the $1500 & start paying $210 + a month or Re-finance our house to pay off the debt. My wife was warned not to let them keep serving us or the firm would put a Lein on our house. I have a question about the lein

1) If a lein is put on our house is it for just what is owed or can they add more charges on the amount owed?

Someone will correct me if I'm wrong.


In order to place a lein on your home, first they have to sue you and win. If the sue you and win, then they will add the court costs to the lein too, so it could get to be a very high amount.

Is your home titled in both of your names, only hers or only yours?
