defaul judgement, what now? What is the name of your state (only U.S. law)? Texas I was served with a notice to answer, and I did appropriatly. a hearing was set, I filed for a continuance, continuance granted..... next thing I hear is a letter from court saying default judgment was awarded to plaintiff. I spoke to court clerk. she said a letter was mailed for notice of hearing...I didn't get it. So, now there is a default judgement....(I know "I didnt appear" thats not my question) I need to appeal. where do I start? also, I understand in Texas with a judgement they can go after my checking account. How do I stop that from happening? thank you for your time. |

Thank you for your input. I appreciate your helpfullness. I have another question now: Can any one tell me what are the rules for being notified of a hearing in Texas? I have read the code and it is confusing. simply...Are they required to notify with certified or registered mail. reason asked is it is sent by "regular mail" there isn't any way to prove I actually recieved notice. thanks again for all the help and time in this matter |

| I sorry Wireless I misunderstood your response ![]() IsabellaSoriano: "that stalls the judgement. doesn't make the judgement go away in it's entirety. the judgement may be vacated, but it only buys time. they will still have to deal with paying the end result." Why are you so sure the OP is the one liable? Whatever happened to due process???? |
