Default Judgment Process


"Georgia": We were served a summons and complaint for judgement from a creditor in the state of Georgia. We have tried to arrange an affordable payment plan thru creditor with no success. How should we respond to their complaint? And what will happen if we lose the case and a judgement by default is issued? Is it possible they will garnish wages or freeze our bank accounts?

Respond to their complaint by telling the truth. When the judgement is entered against you, you will be held responsible for the original debt, interest at the statutory rate, court costs and attorney's fees.

... And yes all three of those possibilities are real unless your state does not allow wage garnishments (google for that info).
