defaulted studen loans

What is the name of your state (only U.S. law)? Texas, I live currently

I have defaulted on my student loans and they are garnishing my wages. Since I am paying the garnishment, is ther a way I can get my wages ungarnished and start making payments on my own? How would I go about that? I think I have to go to Austin to court if I understood the website correctly. Do I need a lawyer to go with me? and if so what type of laywer do I need?

Wages in Texas can't be garnished.

Is your paycheck from out of state?

For individuals living in Texas who are paid from an out of state location, there is case law (Baumgardner vs. Sou Pacific 177 S.W. 2d 317) to support taking a judgment from Texas, domesticating the judgment in the foreign state, then filing the wage garnishment there. Many creditors have used this strategy successfully.
