dental bill


What is the name of your state? n.y.
ok..here goes....went to my dentist.2 bad teeth,said he wouldn't pull them....made an appointment for an oral surgeon,they asked if I wanted anesthesia,,,I said of course.....filled out the paper work...checked with my insurance,,,it would be covered for oral surgery....went to sleep...woke up and the teeth were gone.....great....Got the bill....the insurance didn't cover the anesthesia,when I called them they told me the teeth were "simple extractions" therefore not covered.I called the Dr's office and they told me he makes that decision when he looks at them,I never had a prior exam by him..the consent for anesthesia form clearly states this is a surgical procedure.
Given the information I was given I opted for anesthesia,I would have taken a local anesthesia if I knew they were to be removed as simple extractions,paid the bill except the anesthesia charge,sent them a letter of dispute,they sent the collection co. after me..coresponded with them approx 2 weeks...made him aware of the consent form that stated it was a surgical procedure....he said he would talk to the DR....last I heard from him....it has been 6 months..I checked my credit report..it shows it in collection......
Now...with that said......how do I arbitrate it...or mediate it......I do want it settled.....but small claims court is for recovering money someone owes....they have not sued me....I just want the case heard somewhere.
