I left a $1000.00 cash deposit with a private seller for the vehicle, he issued a non- dated signed reciept to me. The reciept did not state no refunds or deposit is non-refundable. The reciept stated balance to be paid in full by 12-19-04. Due to a few family emergencies I had to back out of the deal. A week after I left the deposit I contacted him by phone and requested my deposit be returned. He indicated that he had spent the money and would do what he could. I have called him and finally spoke with him yesterday, he indicated that he didn't have any money and perhaps I could buy the dragster down the road. I need my deposit back. Any help will be appreciated.

Sorry, but unless the seller decides to return the 'deposit', you are very likely out of luck.
One of the purposes of a deposit is to assure the seller that you are in fact serious about the purchase.... and to compensate the seller for any losses (damage) that he/she might incur if you BREACH your agreement to purchase.
Your only option is to pursue a return in court.... and the chances of success are slim (in my opinion). Especially if the seller is able to prove 'damage' due to your failure (such as having to sell for a less price than you had agreed to).
